§ 5.98. Time limit for filing application for permit.

  • Any person who possesses a current business license for an adult or sexually oriented business that is not subject to section 5.82 or who operates a business which was not deemed to be an adult or sexually oriented business prior to the effective date of this ordinance but which, through an expansion of such business in the manner set forth in section 5.82 is deemed to constitute an adult or sexually oriented business under this article and who does not have a validly issued adult or sexually oriented business permit issued pursuant to the provisions of this article, and all persons required by this article to obtain an adult or sexually oriented business employee permit, must apply for and obtain such permit within ninety (90) days of the effective date of this article. Failure to do so and continued operation of an adult or sexually oriented business, or the continued performances depicting specified anatomical areas or specified sexual activities in an adult or sexually oriented business after such time without a permit shall constitute a violation of this article.
